Bid Protest
A formal challenge by an interested party to a US federal solicitation or award decision, filed with the agency, GAO, or the Court of Federal Claims.
What is Bid Protest?
A bid protest is a written objection by an interested party — generally an actual or prospective offeror whose economic interest is affected — to the terms of a federal solicitation or to an award (or proposed award) decision. There are three principal forums: an agency-level protest filed with the contracting agency; a protest to the Government Accountability Office (GAO); and a protest at the US Court of Federal Claims. Each has its own procedures and timelines.
Timing is decisive. Protests about defects apparent on the face of a solicitation generally must be filed before the bid or proposal due date. Protests against an award generally must be filed within strict day-count deadlines (for GAO, typically within 10 days of when the basis of protest is known, with a specific timing rule that can trigger an automatic stay of performance if a debriefing is involved). Missing the deadline usually forecloses the protest.
For vendors, a protest is a serious step with strategic and relationship consequences. The strongest protests rest on clear procedural error — unequal treatment, evaluation inconsistent with the stated criteria, or an improper sole-source justification — rather than mere disagreement with the outcome. A debriefing often surfaces the information needed to decide whether grounds exist, which is why requesting one promptly is standard practice.
Example
After losing a best-value award, a vendor's debriefing reveals the agency credited the winner for an experience requirement the solicitation did not list; the vendor files a timely GAO protest alleging evaluation inconsistent with the stated criteria.
